Terms of Service

You must be at least 18 and able to enter a binding agreement. The service is offered for legitimate business use. If you act for a company, you confirm that you have authority to bind it.

SetMyDM may provide funnel analysis, AI-assisted Instagram message handling, lead qualification, follow-up, booking support, reporting and human setter review. The exact scope, pricing and service period are defined in the applicable proposal or agreement.

Website and demo conversations are illustrative unless explicitly connected to a live client account.

You are responsible for the accuracy of information and materials you provide, your offer and sales claims, your Instagram and third-party accounts, and having the permissions and lawful basis needed to process lead and conversation data.

You must review commercial terms, guarantees, pricing rules and other sensitive statements configured for your account and notify us promptly if anything changes.

You may not use the service for unlawful, deceptive, abusive or discriminatory activity; spam or unauthorized cold outreach; impersonation without permission; collection of sensitive data that is not needed; infringement of another person’s rights; or attempts to bypass security and platform restrictions.

AI outputs can be incomplete or wrong and should not be treated as professional, legal, medical or financial advice. Guardrails and human review reduce risk but cannot eliminate it. You remain responsible for your offer, client decisions and compliance obligations.

The service depends on providers such as Instagram or Meta, ManyChat, Calendly, hosting, storage and AI providers. Their outages, policy changes, account restrictions and discontinued features may affect the service and are outside our control.

Fees, billing dates, refunds, cancellation rights and any minimum term are stated in your signed agreement. We may suspend access for nonpayment, security risk, unlawful use or a material breach.

You retain ownership of your brand materials and business data. SetMyDM retains ownership of its software, prompts, workflows, templates, methods and pre-existing materials. Each party must protect the other party’s confidential information and use it only for the service relationship.

Unless a signed agreement expressly says otherwise, we do not guarantee revenue, bookings, response rates, platform availability or any particular business result. Results depend on lead quality, offer, market, sales process, account history and other factors outside our control.

To the fullest extent allowed by law, the website and service are provided without implied warranties of merchantability, fitness for a particular purpose or uninterrupted operation. Neither party is liable for indirect, incidental, special or consequential loss except where liability cannot legally be limited. Any specific liability cap will be stated in the signed service agreement.

We may update these website terms prospectively. A signed service agreement controls dispute procedures and governing law; otherwise applicable law applies. Questions can be sent to hello@setmydm.com.
